By accessing and using Merge ("the Platform"), you accept and agree to be bound by the terms and provision of this agreement. If you do not agree to these Terms of Service, please do not use the Platform.

Merge is a marketplace platform that connects users with verified experts for consultations via text chat, video calls, and recorded answers. The Platform facilitates connections but does not provide the expert services directly.

Services Include:

• Text chat consultations with experts
• Video call consultations (scheduled or instant)
• Recorded answer requests
• Expert discovery and booking
• Payment processing and transaction management

3.1 Registration: You must create an account to use our services. You agree to provide accurate, current information and maintain the security of your account credentials.

3.2 Account Types:

• Users: Can search, book, and consult with experts
• Experts: Must verify credentials and provide professional services

3.3 Account Security: You are responsible for all activities under your account. Notify us immediately of any unauthorized access.

All experts undergo a verification process to ensure quality and authenticity. However, Merge does not guarantee the accuracy of advice or outcomes from consultations. Users should verify expert credentials independently.

5.1 Pricing: Experts set their own rates. All prices are displayed clearly before booking.

5.2 Platform Fee: Merge retains 30% of each transaction. Experts receive 70%.

5.3 Payment Processing: All payments are processed securely through Stripe. Payment information is never stored on our servers.

5.4 Refunds: See our Refund Policy for details on cancellations and refunds.

You agree NOT to:

• Harass, abuse, or harm other users or experts
• Share false, misleading, or fraudulent information
• Attempt to circumvent payment systems
• Use the Platform for illegal activities
• Upload malicious code or viruses
• Impersonate others or misrepresent credentials
• Scrape or extract data from the Platform

All content on the Platform, including text, graphics, logos, and software, is owned by Merge or its licensors and protected by copyright and trademark laws.

User Content: You retain ownership of content you submit but grant Merge a license to use it for platform operations.

TO THE MAXIMUM EXTENT PERMITTED BY LAW: Merge is not liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid to Merge in the past 12 months.

Merge does not guarantee the accuracy, reliability, or quality of expert advice. Consultations are provided "as is" without warranties.

We reserve the right to suspend or terminate your account at any time for violations of these Terms or for any other reason at our sole discretion. You may close your account at any time through your account settings.

10.1 Governing Law: These Terms are governed by the laws of the jurisdiction where Merge is registered.

10.2 Arbitration: Any disputes shall be resolved through binding arbitration, except where prohibited by law.

10.3 Class Action Waiver: You agree to resolve disputes individually, not as part of a class action.

We may update these Terms at any time. Continued use of the Platform after changes constitutes acceptance of the new Terms. We will notify users of material changes via email or platform notification.

Experts are solely responsible for all content they create, upload, share, or provide through the Platform. This includes but is not limited to:

• Advice and recommendations given during consultations
• Profile information, credentials, and qualifications
• Documents, files, images, and videos shared with users
• Recorded answers and any downloadable content
• Messages and communications through the Platform

Experts warrant that their content is accurate, does not infringe on third-party rights, and complies with all applicable laws and professional standards. Merge does not endorse, verify, or assume responsibility for expert-generated content.

Merge operates solely as a marketplace platform, not as a publisher or content provider.

The Platform facilitates connections between users and independent experts. Merge:

• Does NOT employ the experts listed on the Platform
• Does NOT create, edit, or control the content provided by experts
• Does NOT guarantee the accuracy, completeness, or quality of expert advice
• Does NOT assume liability for outcomes resulting from consultations
• Acts only as an intermediary to connect users with independent service providers

Users acknowledge that any engagement with experts is a direct relationship between the user and the expert, with Merge serving only as the facilitating platform.

Merge reserves the right to automatically remove malicious, harmful, or policy-violating content without prior notice.

Content subject to automatic removal includes:

• Malware and viruses: Any files containing malicious code, trojans, ransomware, or harmful software
• Spam and phishing: Deceptive content designed to mislead users or steal information
• Illegal content: Material that violates applicable laws or regulations
• Harassment and abuse: Content that threatens, harasses, or discriminates against others
• Copyright infringement: Unauthorized use of copyrighted material
• Fraudulent content: False credentials, fake reviews, or misleading information

Merge may use automated systems, AI-powered moderation, and manual review to detect and remove violating content. Repeat offenders may have their accounts suspended or permanently terminated.

ALL DOWNLOADABLE CONTENT PROVIDED THROUGH THE PLATFORM IS OFFERED "AS IS" WITHOUT ANY WARRANTY OF ANY KIND.

Merge expressly disclaims all warranties, whether express, implied, statutory, or otherwise, including but not limited to:

• No warranty of merchantability: Downloads are not guaranteed to be fit for any particular purpose
• No warranty of accuracy: Content accuracy is the sole responsibility of the expert who created it
• No warranty of security: While we implement security measures, we cannot guarantee that downloads are free from all malware or security vulnerabilities
• No warranty of compatibility: Downloaded content may not be compatible with all devices, software, or systems
• No warranty of availability: Downloaded content may become unavailable at any time

USER RESPONSIBILITY: Users download content at their own risk. We strongly recommend using up-to-date antivirus software and scanning all downloaded files before opening them. Merge shall not be liable for any damages resulting from downloaded content, including but not limited to data loss, system damage, or security breaches.
